1. Why this policy exists
Washington's My Health My Data Act, and similar laws in other states, require businesses to publish a separate, clearly linked policy describing how they handle "consumer health data." We operate a restaurant in Seattle, WA, and this page applies that law's protections to visitors of mikiyaofficial.com regardless of which state they're in.
2. What "consumer health data" means
Under these laws, "consumer health data" is broadly defined as personal information that is linked, or reasonably linkable, to a consumer and that identifies their past, present, or future physical or mental health status — for example, health conditions, diagnoses, biometric data, or precise location information that could reveal an attempt to obtain health care services.
3. What we collect and don't collect
Mikiya is a restaurant business. We do not operate any health-tracking feature, biometric scanner, or health app integration on our website or membership program, and we do not use precise geolocation to track visits to health care facilities.
The one place health-adjacent information can enter our records is if you voluntarily tell a server about a food allergy or dietary restriction, as described in our Privacy Policy. We use that information only to serve your visit — to help the kitchen avoid an allergen, for example. We do not use it for advertising, profiling, or any purpose beyond your dining experience, and we do not treat it as a formal "consumer health data" collection program under the Act.
4. We do not sell consumer health data
We do not sell, and have never sold, consumer health data to any third party, for money or anything else of value. We do not share it with advertising partners such as Meta or Google.
5. No health-facility geofencing
We do not implement geofences around any health care facility to identify, track, collect data from, or send messages or advertisements to consumers.
6. Your rights
To the extent we hold any consumer health data about you, you have the right to:
- Confirm whether we are collecting, sharing, or selling your consumer health data.
- Access that data, including a list of any third parties it has been shared with.
- Withdraw consent for our collection or sharing of it.
- Delete the consumer health data we hold about you.
- Appeal a denial of any of the above requests.
We will not discriminate against you for exercising these rights.
7. How to exercise your rights
Contact us using the details in Section 9. We will verify your identity before acting on a request — usually by confirming the phone number or email on your membership account, if you have one — and will respond within the time required by applicable law. If we deny a request, we will explain how you can appeal.
8. Changes to this policy
We may update this policy from time to time. The "Last updated" date at the top of this page shows when it was last revised.
